Agreement to these terms

These terms apply to your use of generawealthllc.com (the "Site") and to text messages between you and GenEra Wealth, LLC ("GenEra Wealth," "we" or "us"). By using the Site or agreeing to receive our texts, you accept these terms. If you do not agree, please do not use the Site, and reply STOP to stop our texts. Client services are governed by your signed advisory agreement, not by these terms. If the two conflict, your advisory agreement controls.

Information only, not advice

• The Site is for general information. Nothing on it is personalized investment, tax, legal or accounting advice, or an offer to buy or sell any security.
• Using the Site, submitting a form, or exchanging texts or emails with us does not create an advisory relationship. That begins only when you and GenEra Wealth, LLC sign an advisory agreement.
• We provide advisory services only where we are registered or exempt from registration. See our Disclosures page for where that is today.
• Investing involves risk, including the loss of principal. Past performance does not guarantee future results.
• Tax and legal rules change. Talk with a qualified professional about your own situation before acting on anything you read here.

Using the Site

You may use the Site for lawful, personal, non-commercial purposes. You agree not to interfere with the Site or its security, try to access parts of it you are not meant to reach, use automated tools to copy it at scale, or submit information that is false or belongs to someone else. Information you give us through the contact form must be accurate, and you must be authorized to give it.

Text messaging

You agree to receive information messages (appointment reminders, account notifications, etc.) from GENERA WEALTH. Message frequency varies. Message and data rates may apply. For help, reply HELP or email us at jarrett@generawealthllc.com. You can opt out at any time by replying STOP.

• We do not accept instructions to buy or sell investments or to move money by text message. If you send one, we will not act on it until we have called you at a number we have on file to confirm it.
• Consent to receive texts is not a condition of buying any service from us.
• After you reply STOP you will get one message confirming you are opted out, and then no more texts from us unless you opt back in. Opting out of texts does not end any other communication with us.
• Text messages are not a secure way to communicate. Please do not send Social Security numbers, full account numbers, passwords or other sensitive information by text. We may ask you to use a more secure method instead.
• Texts may be delayed, not delivered or read by someone else with access to your phone. Do not rely on a text for anything urgent or time-sensitive. Call us instead.
• Your carrier is not responsible for delayed or undelivered messages. Supported carriers and coverage vary. If you change your number, tell us so we do not text someone else.
• We keep a copy of text messages with clients and prospective clients as required by securities law.

Privacy

Our Privacy Policy describes how we collect, use, share and protect your information.

Mobile opt-in information, including phone numbers and SMS consent, will not be shared with third parties or affiliates for marketing purposes. We use it to send the messages you asked for and to keep the records the law requires.

Our content

The Site's text, graphics, logos and design belong to GenEra Wealth, LLC or its licensors and are protected by copyright and trademark law. You may view and print pages for your own use. You may not copy, republish or sell them, or use our name or logo, without our written permission.

Links to other sites

The Site links to websites we do not own, such as our custodian's and government sites. We do not control them and are not responsible for their content, accuracy or privacy practices. A link is not an endorsement.

No warranties

We work to keep the Site accurate and available, but it is provided "as is" and "as available." We do not promise that it will be error-free, uninterrupted or current, and to the fullest extent the law allows we disclaim all warranties, express or implied. Nothing in these terms limits any right you have under federal or state securities law or that cannot be waived by law.

Limit on liability

To the fullest extent the law allows, GenEra Wealth, LLC and its members, officers and employees are not liable for indirect, incidental, special or consequential damages that arise from your use of, or inability to use, the Site or text messaging. This does not limit liability that cannot be limited by law, and it does not change our duties to you as a client under your advisory agreement and applicable law.

Changes to these terms

We may update these terms from time to time. The version on this page is the one that applies, and continued use of the Site or our texts after a change means you accept it. If a change affects text messaging in a way that requires your consent, we will ask for it.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules, and by applicable federal law.
